A BILL to amend and reenact section seven, article twenty-three,
chapter thirty of the code of West Virginia, one thousand nine
hundred thirty-one, as amended, relating to licensure of
radiologic technologists; providing for annual license
renewals; and allowing the board to establish renewal fees
through legislative rulemaking.
Be it enacted by the Legislature of West Virginia:

That section seven, article twenty-three, chapter thirty of
the code of West Virginia, one thousand nine hundred thirty-one, as
amended, be amended and reenacted to read as follows:
ARTICLE 23. RADIOLOGIC TECHNOLOGISTS.
§30-23-7. Issuance of license; renewal of license; renewal fee.





Whenever the board finds that an applicant meets all the
requirements of this article and rules promulgated in accordance
with this article for a license to engage in the practice of radiologic technology, it shall forthwith issue to him or her such
a license. and otherwise the The board shall deny the same a
license to any person failing to meet the requirements of this
article and rules promulgated in accordance with this article. The
license is valid for a period of two years one year from the date
issued and shall may be renewed every two years year without
examination upon application for renewal on a form prescribed by
the board and payment to the board of a renewal fee. of twenty
dollars: The board shall propose for legislative promulgation, in
accordance with the provisions of article three, chapter
twenty-nine-a of this code, a rule setting the license renewal fee.
Provided, That the The board may deny an application for renewal
for any reason which would justify the denial of an original
application for a license.





NOTE: The purpose of this bill is to authorize an annual
rather than a biannual license renewal for radiologic
technologists; and to bring the fee provision of this section into
conformity with §30-1-6 which allows all licensure boards to set
fees by rule.
